Terms of Service
Welcome to Davos HealthcareTM. Please read these Terms of Service (“Terms”, “Terms of Service”) carefully before using or accessing the Davos Healthcare Global Hospital Evaluations, the Star MedallionTM credential framework, or associated digital platforms (collectively, the “Service”).
By accessing or using the Service, you agree to be bound by these Terms, all applicable laws, and regulations. If you do not agree with any part of these Terms, you are expressly prohibited from accessing or using the Service or its proprietary data.
1. Restricted Institutional Access
Access to designated institutional areas of the Service is strictly restricted to authorized healthcare institutions, hospital systems, and their designated representatives engaged in formal evaluation or licensing discussions with Davos Healthcare.
All content, metrics, scores, and benchmarking materials provided within these restricted portals are offered solely for evaluation and partnership discussion purposes. Unauthorized access, sharing, or distribution is strictly prohibited.
2. Intellectual Property & Trademarks
a. Proprietary Rights & Methodology
The Service, including but not limited to the four domain and 10-factor audit methodology, artificial intelligence (AI) data models, algorithmically produced numeric evaluations, data validation, interactive visual layouts, and digital media, is the sole and exclusive intellectual property of Davos Healthcare.
b. License Grant & Restrictions
Davos Healthcare grants authorized users a limited, non-exclusive, non-transferable, revocable license to view and review the evaluations solely for internal, informational, and institutional evaluation purposes. You may not:
- Deconstruct, reverse-engineer, decompile, or extract the four domain and 10-factor audit criteria, evaluation models, or underlying dynamic data analysis.
- Commercially exploit, sell, sublicense, lease, or redistribute any data, tier designations, Star Medallion credential, or content without express written consent from Davos Healthcare.
- Scrape, automate data extraction from, or frame any portion of the Service.
c. Proprietary Trademarks
“Davos Healthcare™”, “Star Medallion™”, “The C3 Davos of Healthcare™”, “Davos of Healthcare™”, and associated visual logotypes are trademarks of Davos Econometrics. These marks identify the global analysis platform, numeric evaluations, Star Medallion tiers, and associated institutional recognition programs.
- Licensing Requirement: Display or use of the Star Medallion™ mark, score, or tier designation by any hospital, health system, or commercial entity is permitted strictly under the terms of a formal, executed Star Medallion Credential and Licensing agreement.
- Prohibition: Unauthorized use, reproduction, modification, or imitation of these marks is strictly prohibited.
3. Medical & Clinical Disclaimers
THE SERVICE DOES NOT PROVIDE MEDICAL ADVICE OR CLINICAL DIAGNOSES.
- Benchmarking Purpose: The evaluations, ratings, and metrics provided by Davos Healthcare are intended strictly for institutional and administrative evaluation, and general informational purposes. They do not constitute clinical, financial, regulatory, or formal accreditation advice.
- No Guarantee of Outcomes: Star Medallion evaluations reflect aggregate data analysis and comparative healthcare evaluation. They do not guarantee individual patient outcomes, clinical safety, or treatment quality.
- Clinical & Operational Decision-Making: Users, medical professionals, and patients should not make healthcare delivery decisions, clinical protocols, or provider selection choices based solely on these evaluations. The Service is not a substitute for professional medical judgment or formal regulatory compliance and clinical standards reviews.
4. Evaluation Methodology & AI Disclaimer
Star Medallion™ evaluations are AI-assisted, relative assessments produced for comparative analysis.
- Dynamic Updating: Numeric evaluations and Star Medallion tier designations reflect relative performance within the proprietary Davos Healthcare dataset at a given point in time and are updated as underlying metrics change.
- Data Sources & Third-Party Information: Evaluations integrate third-party public metrics and self-reported institutional data. Davos Healthcare makes no warranties or representations regarding the completeness, accuracy, timeliness, or validity of third-party and self-reported data incorporated into any evaluation.
5. Limitation of Liability & “As-Is” Provision
The Service, evaluations, and all materials are provided strictly on an “AS-IS” and “AS-AVAILABLE” basis. Davos Healthcare makes no warranties, expressed or implied, and hereby disclaims all other warranties, including without limitation:
- Implied warranties or conditions of merchantability;
- Fitness for a particular purpose;
- Non-infringement of intellectual property or freedom from technical errors.
In no event shall Davos Healthcare, its parent entities, partners, directors, officers, employees, or agents be liable for any direct, indirect, incidental, consequential, special, or punitive damages (including, without limitation, loss of data, loss of revenue/profit, business interruption, or reputational damage) arising out of the use of, or inability to use, the Service or reliance upon its metrics, even if advised of the possibility of such damage.
6. Indemnification
You agree to defend, indemnify, and hold harmless Davos Healthcare, its officers, directors, employees, affiliates, and agents from and against any third-party claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable legal and attorneys’ fees) arising out of or relating to:
- Your violation of these Terms of Service;
- Your unauthorized use or misuse of the Evaluations, Star Medallion credentials and marks, or platform data; or
- Operational decisions made by your institution relying upon platform outputs.
7. Privacy & Data Protection
When you submit an institutional inquiry or register for access, Davos Healthcare collects personal and organizational details, including your name, corporate role, institution name, professional email address, telephone number, and message content.
- Use of Data: This information is used strictly to facilitate engagment, evaluation, and licensing discussions with the Davos Healthcare team.
- Data Sharing: Inquiry data is handled confidentially, is stored securely in compliance with applicable data protection regulations, and is never sold or shared with third parties for marketing purposes.
8. Governing Law & Jurisdiction
Any claim, dispute, or legal proceeding relating to the Service or Davos Healthcare shall be governed by and construed in accordance with the laws of the jurisdiction in which Davos Healthcare is headquartered, without giving effect to any principles of conflicts of law.
9. Modifications to Terms
Davos Healthcare reserves the right to revise, update, or modify these Terms of Service at any time without prior notice. By continuing to access or use the Service following any updates, you agree to be bound by the revised Terms of Service.
